St Mark Coptic Orthodox Church of Australia (Inc) (hereafter referred to as “the Church”), has taken reasonable care to ensure that the material is correct and current at the time of publication but makes no warranty, either express or implied, concerning the suitability, reliability, availability, timeliness or accuracy of the material or any linked site for any purpose. This website (excluding any linked sites) is controlled by the Church. These terms of use and your use of this website are governed by the laws of the Australian Capital Territory (ACT), Australia, and you consent to the exclusive jurisdiction of the courts of the ACT, Australia.

The Church makes no representation that the content of this website complies with the laws (including intellectual property laws) of any country outside Australia. PRIVACY STATEMENT

The Church values the privacy of every individual and is committed to handling personal information in accordance with the Australian Privacy Principles (APP) as governed by the Privacy Act (1988). Protecting your privacy by handling your personal information in this manner is an important aspect of our activities.

This website privacy statement only applies to websites, webpages and electronic addresses operated, maintained or administered by the Church. This privacy statement does not apply to any linked or other web spaces. If you register to use a mobile application which collects personal information, the terms and conditions associated with the application (if any) will govern how that personal information is managed.

This privacy statement explains how your personal information will be handled by the Church when you access and interact with its web spaces including any service accessible through its web spaces that facilitates interactive information sharing. Examples of web services include social-networking services (e.g. Facebook), wikis (e.g. Wikipedia), blogs, micro-blogs (e.g. X (formerly twitter)) and web feed services (e.g. RSS feed).

The Church recommends that you read any terms and conditions (including any privacy statement or policy) that apply to any web service as any such terms and conditions relating to the handling of your personal information by the web service will prevail over this privacy statement to the extent of any inconsistency.

The Church may update this privacy statement from time to time. Any changes to this privacy statement will be published on this page.

COLLECTION OF YOUR PERSONAL INFORMATION

The Church only collects personal information that you voluntarily submit. This collection maybe in person, via email, through a telephone conversation with you or through Church applications or services like “St Mark Booking system”, “Sunday School Service” or any other mobile applications developed/used by the Church on iOS & Android platforms. The types of personal information that the Church may collect through its web spaces include:

  • your name, email address, telephone number, IP address and other contact or identification detail
  • photographs, videos and news stories in respect of the Church related events and activities;
  • the content of any online application, enquiry, submission, subscription, survey or complaint that you submit to any of its web spaces
  • the content of any other solicited or unsolicited electronic communication that you send to any of its web spaces
  • any registration information that you provide to use any Web Service which is accessible through any of its web spaces
  • the content of any comments that you post to, or otherwise make available on, any of its web spaces using any web service
  • any other information that you provide to, or make available on, any of its web spaces
  • metadata relating to any electronic communications that you send to any of its web spaces. Examples of metadata include your electronic address, time and date sent, time and date received, unique message identification, message type, message length, etc.

We do not automatically collect personal information without your knowledge. The Church relies upon you to ensure that any personal information that you provide to, or make available on its web spaces is accurate, current, complete and relevant. The Church also relies upon you to advise it of any changes to such personal information.

You can browse any of the Church’s web spaces anonymously without disclosing any of your personal or health information to the Church. However, if you do not provide any information requested on any of the Church’s web spaces for the provision of a service then the Church may not be able to provide the service to you.

COLLECTION OF PERSONAL INFORMATION ABOUT OTHER PERSONS

At or before the time that you provide to, or make available on, any of the Church’s web spaces any personal information about another person, the Church relies upon you to take reasonable steps to ensure that the person is aware:

  • that such information will or has been provided to the Church
  • how the person can access to his or her information
  • the purposes for which the information was provided to the Church
  • to whom the Church usually discloses information of that kind
  • any law that requires the information to be provided to the Church
  • the main consequences (if any) for the person if all or part of the information is not provided to the Church.

You are not required to make a person aware of the above matters where doing so would pose a serious threat to the life or health of any person or would involve the disclosure of information given in confidence.

PURPOSE OF COLLECTION

The personal information that the Church collects and holds about you, depends on your interaction with the Church. Generally, the Church collects, uses and holds your personal information if it is reasonably necessary for or directly related to the performance of the Church’s functions and activities and for the primary purpose of:

  • fulfilling the mission and directions of the Church;
  • communicating with you about the services we offer;
  • providing services or products to you or someone else you know;
  • considering and processing various application and registration forms, including for the purposes of Sunday School;
  • seeking donations;
  • facilitating internal business operations;
  • providing you with information about upcoming events, functions and fundraising activities that may be of interest to you;
  • for marketing or promotional purposes;
  • distributing de-identified aggregated statistical information for reporting purposes;
  • complying with legal or regulatory requirements; and
  • dealing with complaints or enquiries.

USE AND DISCLOSURE OF PERSONAL INFORMATION

The Church will not use or disclose any personal information that it collects through any of its web spaces unless the use or disclosure is:

  • for the primary purpose for which the information was collected
  • for a secondary purpose related or directly related to the primary purpose for which the information was collected and which the person would reasonably expect required or authorised by law
  • for any other purpose permitted under the Privacy Act (1988) in ACT (Australia) or The Health Records (Privacy and Access) Act 1997 in ACT (Australia).

Subject to the requirements of the Privacy Act (1988) in ACT Australia, the Church may need to disclose personal information which it collects through its web spaces to:

  • The Church’s service providers which provide website, archival, auditing, professional advisory, banking, mail house, delivery, recruitment, call centre, technology, research, utility, security, electronic payment or application processing services
  • Organisations acting on your behalf, for example your solicitor or interpreter.

INFORMATION PROVIDED TO WEB SERVICES

Any personal information which you provide to, or make available on, any of the Church’s web spaces using any web service may be accessible to other users of the web service who are not officers, employees or contractors of the Church and, if the web service is provided by a third party. Other users of, and third parties which provide, such a web service may use or disclose your personal information which you provide to, or making available using, the web service for any purpose including for the purpose of sending you unsolicited electronic communications. You acknowledge and agree that the Church is not responsible for any such use or disclosure.

SECURITY

The Church stores your personal information in different ways, including in paper and in electronic form. The security of your personal information is important to the Church and the Church takes all reasonable measures to ensure that your personal information is stored safely to protect it from misuse, loss, interference, unauthorised access, modification or disclosure, including electronic and physical security measures.

The Church stores your personal information in servers located in Australia.

WEB STATISTICS AND DATA COLLECTION

The Church uses web analytics software to collect usage statistics for its web spaces. This information is not used by the Church to identify you or match your identity with any of your personal information.

CLICKSTREAM DATA

The following non-personal information may be automatically recorded by the web server of any of the Church’s web spaces for statistical and system administration purposes: your server address your top-level domain name (e.g. .com, .au, .gov) the date and the time of your visit to the site the pages you accessed and downloaded the address of the last site you visited, your operating system, the type of browser you are using. To the extent that any clickstream data could make you identifiable, the Church will not attempt to identify you from such clickstream data unless necessary for the investigation of unlawful activity or otherwise permitted under The Privacy Act (1988) in ACT (Australia).

COOKIES

Like many others, the Church’s web spaces and web services accessible through the Church’s web spaces may use cookies from time to time. Cookies are small data files that a web space or web service places on a user’s hard drive to record aspects of that user’s experience of the web space or web service respectively. Cookies are not used to identify you or record any of your personal information. The default settings of your browser may allow some or all cookies, but you can easily take steps to erase cookies from your hard-drive, block all cookies or receive a warning before a cookie is stored on your hard-drive. However, a web space or web service may not function fully if you disallow cookies.

ACCESS AND CORRECTION

You may access the personal information we hold about you, by making a written request. The Church will respond to your request within a reasonable period. We may charge you a reasonable fee for providing access to your personal information (but not for making a request for access).

The Church may decline a request for access to personal information in circumstances prescribed by the Privacy Act, and if we do, we will provide you with a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons).

If, upon receiving access to your personal information or at any other time, you believe the personal information we hold about you is inaccurate, incomplete or out of date, please notify the Church immediately. The Church will take reasonable steps to correct the information so that it is accurate, complete and up to date.

To modify your personal information or to unsubscribe to any application, or to make a complaint about how we have handled your personal information, please email the public officer on at Publicofficer@StMarkACT.org.au.

NOTIFIABLE DATA BREACHES

If you believe that a data breach has occurred in relation to your personal details, please contact the public officer on Publicofficer@StMarkACT.org.au providing details and circumstances of the data breach. The advised breach will be investigated immediately, and you will be informed of remedial action to be undertaken.

If the breach constitutes a Notifiable Data Breach under the Privacy Act, the Office of the Australian Information Commissioner (OAIC) will be informed as soon as practicable of the breach and provided with the full circumstances and remedial action undertaken by the Church.

REFUND POLICY – DONATION

We are grateful for your donation and support of our organisation. Donations are normally non-refundable but if you have made an error in making your donation or change your mind about contributing to our organisation please contact us. Refunds are returned using the original method of payment. If you made your donation by credit card, your refund will be credited to that same credit card.

AUTOMATED RECURRING DONATION CANCELLATION

Ongoing support is important to enabling projects to continue their work, so we encourage donors to continue to contribute to projects over time. But if you must cancel your recurring donation, please notify us immediately.
